The Ahmedabad Municipal Corporation (AMC) has imposed a ₹50 lakh penalty on the agency operating the Sola sewage treatment plant following the death of a worker at the facility.
It has separately ordered ₹30 lakh in financial assistance to the deceased worker's family. No police complaint has been filed.
AMC officials say they will decide on legal and criminal action only after receiving the project management consultant's formal report.
Read the order of operations. The financial consequence arrived before the causal finding.
In a fatality at an operating utility, that is unusual — and it tells you more about AMC's risk position than the penalty amount does.
AMC is principal, asset owner, and supervisor of the same O&M contract it has now penalised. Its sewerage wing oversees the operator; its appointed PMC supervises the work.
If the PMC's report finds that safety supervision failed, the finding does not stop at the operator's gate.
That is the reason the criminal question is being held behind a consultant's document.
A police complaint converts an administrative matter into an investigation of supervisory duty, and supervisory duty in this case runs back to AMC.
The operator is not named in the reported account, nor is the PMC. Both matter commercially.
The operator carries the ₹50 lakh hit, residual exposure to prosecution, and the live possibility of being excluded from future AMC tenders.
The PMC now holds the decisive evidentiary role in whether a fatality becomes a criminal case — a position no consultant should hold comfortably, and one that should force every municipal O&M tender to specify the following as priced, auditable scope rather than incidental service:
- PMC independence
- Site-visit frequency
- Record retention
The compensation mechanism is also unresolved. Whether the ₹30 lakh flows from AMC's budget, the operator's performance security, or an insurer determines who is actually funding the consequence — and none of the three has been disclosed.
Gujarat's municipal corporations have been among the more aggressive users of penalty and security-withholding provisions against O&M contractors. This precedent now sits in front of every bidder pricing municipal sewerage O&M in the state.
Confined-space entry, gas exposure, and electrical maintenance at STPs are the recurring hazard classes, and they are the classes contractors have historically priced as operational routine. Expect that to change.
With penalty exposure arriving ahead of causation findings, fatality risk becomes a direct input to O&M rate build-up, and safety systems become a competitively differentiating line item rather than a compliance formality.
Contractors bidding AMC and Gujarat municipal O&M work should assume the PMC report is the document that decides their legal future, not the incident report.
Build the site records that survive it.
