Gyanesh Kumar Road File: Rs 700 Crore, Still No Verdict

The contract and the loss

The contract was Rs 215 crore.

The loss P K Basheer put on the floor of the Kerala Assembly on October 29 is Rs 700 crore.

The Public Works Minister was replying to BJP MLAs B B Gopakumar, V Muraleedharan and Rajeev Chandrasekhar on the Vigilance and Anti-Corruption Bureau preliminary enquiry into the Kerala State Transport Project's MC Road rebuild between Angamaly and Thiruvananthapuram. The officer who cleared it was Gyanesh Kumar, then PWD secretary, now Chief Election Commissioner.

The VACB report is not ready.

That ratio is the story.

A loss above three times contract value does not arise from padded bills.

It points to:

- Re-tendering
- Rectification of failed work
- Idle-plant claims
- Abandoned stretches

Each leaves a paper trail.

Basheer said the 2006 VACB enquiry carried certain discrepancies. Twenty years to find them.

The award and the complaint

The award went to PATI-BEL, a joint venture of the Malaysian firm PATI and Bhageeratha Engineering Ltd, on World Bank funding.

PATI's project engineer, Lee See Been, raised complaints during construction, returned to Malaysia, and died by suicide there. Those complaints were the closest thing to real-time field data this package generated. Nothing on record shows they reached a conclusion.

Who carries the exposure

For contractors the exposure is structural. A JV with a foreign lead partner on a multilateral-funded package creates jointly held liability with no sunset clause.

Bhageeratha Engineering remains named in a live file two decades later because its partner's engineer spoke and the client's vigilance chain did not close.

Officers carry the same asymmetry. Gyanesh Kumar's 2006 signature is under test while he holds a constitutional office.

A holding answer, and what to watch

Basheer gave the House a holding answer.

No timeline. No disclosed scope.

Watch whether the enquiry is re-scoped against the World Bank's fraud and corruption framework. If it stays inside Kerala's own vigilance machinery, the file will run again, and the next engineer who writes a complaint into it should assume nobody will read it for twenty years.
