MoRTH Interim Reprieve for NH-202

Nagaland’s long-stalled NH-202 widening has shifted from legal deadlock to a Cabinet-track approval after the Ministry of Road Transport and Highways (MoRTH) granted an interim reprieve on land acquisition and agreed to accept the submitted Detailed Project Report (DPR) despite identified technical deficiencies.

Deputy Chief Minister TR Zeliang — who holds the Planning, Transformation and National Highways portfolio — secured the concessions in an August 19 meeting in New Delhi with the MoRTH Secretary, Director General and Additional Director General.

Legal Concession Under Article 371(A)

The decisive concession is legal, not administrative.

MoRTH has enabled the state to proceed under the Nagaland Land (Requisition and Acquisition) Act, 1965 instead of the National Highways Act, 1956, deferring to Nagaland’s Article 371(A) constitutional protections.

The single-lane to two-lane widening covers the following corridors:

- NH-202 through Tuensang, Shamator and Kiphire
- NH-329A
- NH-702A
- Foothill Road

Acquisition will now run on a state-governed compensation and land-record framework.

Commercial and Procurement Implications

The commercial read is direct: Nagaland gains schedule certainty while execution risk moves downstream.

Accepting a DPR with known gaps avoids a fresh consultant appointment and several months of surveys, but alignment, utility-shifting and land-record uncertainties are more likely to emerge as variation orders once an EPC or construction contractor mobilises.

The unnamed state-appointed consultant retains design liability, yet prospective tenderers must price a document MoRTH itself has flagged as incomplete.

For procurement and delivery teams, the wider signal is that special-category states can now push central highway schemes through state land statutes — a precedent affecting compensation benchmarks, title diligence and dispute exposure.

The near-term test is whether the technical fixes agreed between the state consultant and MoRTH engineers close out before Cabinet sanction, or get inherited by the contractor in the field.
