The Thane District and Additional Sessions Court, presided over by Judge P.V. Ghule, dismissed the National Highways Authority of India's appeal against enhanced compensation of ₹1,120 per square metre awarded to seven farmers in Bhatane village, Palghar district. The land—650 square metres from Gat No. 56/1—was acquired for the Mumbai-Vadodara Expressway, one of NHAI's flagship greenfield corridor projects.

The Arbitration Underpinning

The ruling is significant not for the quantum alone but for the arbitration dynamics it exposes.

The Competent Authority for Land Acquisition (CALA) initially pegged compensation at ₹765 per square metre in August 2018.

A Sole Arbitrator raised it to ₹1,120 per square metre in February 2025—a 46% increase—based on a sale deed from September 14, 2014.

NHAI challenged this, arguing the enhancement contravened provisions of the National Highways Act and the Arbitration and Conciliation Act, 1996.

Why the Court Refused to Interfere

The court was unpersuaded. Judge Ghule noted NHAI failed to produce any evidence rebutting the genuineness of the sale deed the arbitrator relied upon.

Citing Supreme Court precedents, the court reiterated that arbitral awards can be interfered with only on grounds of patent illegality or conflict with public policy—a threshold NHAI could not meet.

For NHAI's project delivery teams and the Thane Project Implementation Unit, this judgment carries structural implications beyond the 650 square metres in question.

The Mumbai-Vadodara Expressway traverses significant stretches of Palghar, where land acquisition compensation disputes are recurring.

A 46% uplift between initial CALA determination and final arbitral award—subsequently upheld at the Section 34 stage—sets a pricing precedent that neighbouring landowners and their legal counsel will aggressively cite.

The Arithmetic That Escalates Costs

The landowners' argument, which the court effectively endorsed, was that the arbitrator correctly averaged the three highest-value sale transactions from the period preceding the acquisition notification.

This methodology, if replicated across pending disputes, could materially escalate NHAI's land acquisition cost base along the entire Palghar corridor.

A Failing Arbitration Strategy

The commercial signal is clear:

NHAI's arbitration strategy of challenging enhanced compensation without producing countervailing valuation evidence is collapsing at the judicial review stage.

The authority now faces a critical choice:

- Invest in robust valuation expertise during arbitration proceedings to defend CALA-determined rates.
- Accept that CALA-determined rates will face systematic upward revision through the dispute resolution mechanism.

The Finality Imperative

For EPC contractors and developers watching corridor progress, land acquisition finality remains the single largest determinant of construction schedule certainty.

Every upheld compensation award removes one more block of acquisition risk but simultaneously raises the cost baseline against which project viability is measured.
