PNC Infratech's Lucknow Expressway Faces Defect Reckoning

Notices and Initial Defects

The Allahabad High Court’s notices to the Centre, Uttar Pradesh Government, NHAI and the Ministry of Road Transport and Highways open a defect-liability phase for the 63 km Lucknow-Kanpur Expressway barely a month after its 13 July opening.

They place PNC Infratech’s concessionaire, Awadh Expressway Pvt Ltd, at the centre of the exposure.

The trigger was not one failure. Between 13 July and 11 August, depressions, subsidence and patchwork failure surfaced at around 45 locations on the 45 km greenfield section.

Surface slippage near Km 64 in Unnao appeared 13 days after opening. Viral footage of workers using pedestal fans to dry a waterlogged stretch near Begumkheda turned an engineering fault into a public accountability event.

IIT Kharagpur Findings and Liability Shift

What changes the liability equation is IIT Kharagpur’s early diagnostic direction.

Its field team collected 50 samples and found water seepage as deep as 18 feet, with missing drainage near Km 44.7 and settlement between Km 49 and 60.

The emerging conclusion — design and drainage inadequacy rather than isolated workmanship — is commercially significant.

Under concessionaire-led delivery, Awadh Expressway faces not just rework but a contest over whether design scope and monitoring were adequate at sanction stage.

That contest matters for the wider Hybrid Annuity Model pipeline. If defects are framed as design failure, liability migrates beyond a contractor’s built-to-specification defence and into concessionaire development and O&M obligations.

For listed EPC player PNC Infratech, exposure is threefold:

- Rectification cost inside the SPV
- Annuity and reputational risk with NHAI
- A pricing signal across its HAM order book

Institutional Signal

The deeper signal is institutional.

NHAI’s supervision and independent engineer checks did not catch a drainage deficiency that IIT Kharagpur identified within weeks.

Judicial scrutiny is now functioning as a backstop quality gate, with technical institutions deployed as forensic reviewers.

Concessionaires should expect design adequacy — not just construction compliance — to become a contested, bankable risk in future highway awards.
