Fatal NH-27 Crash Becomes Contracting Dispute

The seven deaths on NH-27 at Tetelia near Sonapur have turned a road accident into a contracting and revenue-model dispute.

Assam Chief Minister Himanta Biswa Sarma has publicly blamed the National Highways Authority of India, citing a police finding that the minibus driver lost control after hitting a large pothole. NHAI now faces both a criminal probe and a demand to suspend toll collection across Assam.

The execution failure sits with the unnamed maintenance contractor on the Sonapur stretch. Sarma said the contractor “failed to discharge duties properly.” Under NHAI’s operate-maintain-transfer and maintenance contracts, the toll-collecting entity carries the maintenance obligation.

The structural failure: toll collection continued while the riding surface deteriorated to the point of a fatal head-on collision.

Political Pressure and Contractor Exposure

That gap is the commercial signal. Congress leader Debabrata Saikia has written to Union Road Transport and Highways Minister Nitin Gadkari seeking statewide suspension of tolling until roads are “certified motorable,” plus an independent safety and maintenance audit of every toll plaza.

If performance-linked toll suspension becomes a political enforcement tool, it rewrites revenue risk for toll operators and maintenance contractors in Assam and beyond.

For EPC and OMT contractors, exposure is threefold:

- Criminal liability from the police case
- Contractual penalties from NHAI
- Bid-stage scrutiny of maintenance history

NHAI’s chairman has promised immediate repair and closer monitoring of future maintenance work, a signal the authority will lean on contractors rather than defend the current contract structure.

Compensation, Protests, and the Road Ahead

The state’s Rs 5 lakh compensation per deceased family and free treatment for the injured move liability onto public balance sheets, but do not resolve whether toll revenue is adequately conditioned on pavement performance.

Protesters have shut the Sonapur toll plaza one kilometre from the crash site, refusing to reopen it until repairs are complete.

The real industry signal is not the pothole. Toll-operate contracts in Assam are now being tested against a public-safety standard current maintenance enforcement has failed to meet.

Contractors should expect performance-linked tolling, third-party road-condition audits and stricter defect-liability enforcement to spread as standard terms across NHAI maintenance packages.
