A 30-Month Build Turns Into Three Extensions

Panvel Municipal Corporation’s Swarajya headquarters was meant to be a 30-month build.

Instead, the contract awarded to Harsh Constructions Private Limited on 29 April 2022 for approximately Rs 112.93 crore excluding GST has moved through three extensions and a revised value of roughly Rs 161.49 crore — a 43.01 per cent increase of Rs 48.57 crore before taxes.

The slippage is being read as a contractor problem.

Mayor Nitin Patil has told Loksatta that Harsh Constructions quoted seven per cent below the original amount for the second phase after not studying the tender properly, struggled during execution and could not move beyond five per cent of the work.

That is a serious charge, but it points accountability in the wrong direction.

Pre-Construction Soil Investigation: The Deeper Failure

The more consequential failure belongs to the pre-construction phase.

The site at Plot No. 4, Sector 16, New Panvel was leased from the City and Industrial Development Corporation (CIDCO) on 19 April 2021, and development permission followed on 7 September 2021 — before the work order.

Yet extension records later cited soil strata found roughly 1.5 metres deeper than expected, requiring additional excavation, retaining walls, foundation work and design changes.

That is the real signal.

The tender reportedly required the successful contractor to conduct a fresh soil test before starting work, which shifted geotechnical risk onto the bidder after award.

Foundation variations are among the most expensive changes in any building contract, and they were avoidable if borehole investigation had been completed before the bill of quantities was finalised.

A fixed-price public works contract becomes financially open-ended when the authority transfers investigation risk downstream and then absorbs the cost through variations.

Accountability, Documentation, and the Road Ahead

The accountability gap is exactly what RTI activist Suhas Wankhede has flagged: whether the reasons for each delay, the responsibility, and the eligibility of rate increases have been documented.

Without that record, a genuine site-driven variation is indistinguishable from weak tender preparation.

For municipal bodies across the Mumbai Metropolitan Region, the lesson is procedural. The following controls are not administrative niceties:

- Pre-tender geotechnical investigation
- A frozen design
- An approved variation register

They are the only controls that keep a lump-sum contract from becoming cost-plus in practice.

The remaining questions on bank guarantees, insurance, worker safety and environmental compliance only widen the exposure.

Panvel Municipal Corporation now has to demonstrate which changes were authority-driven, which were site-driven and which trace back to contractor performance — before the extended 31 October 2026 deadline becomes the fourth missed date.
